This literature review delves into the intricate interplay between cultural factors and the implementation of Explainable AI (XAI) within international criminal justice systems. Recognizing the growing significance of AI technologies in legal contexts, this paper focuses on categorizing justice systems based on cultural dimensions such as individualistic vs. collectivist, tight vs. loose, and high context vs. low context. By exploring these dimensions, the paper aims to elucidate how cultural nuances influence the design and deployment of XAI in sentencing algorithms. We delve into the implementation of AI technologies within various global criminal justice frameworks, identifying specific challenges and opportunities that arise. Our study extends to countries such as the United States, China and Germany, offering a comparative analysis of their criminal justice systems in relation to AI integration. Drawing upon theories from disciplines such as psychology and design, the review provides insights into tailoring best practices for XAI in the criminal justice domain. The study not only identifies the unique challenges posed by cultural diversity but also proposes recommendations for developing culturally sensitive XAI systems that promote transparency, accountability, and fairness.
